ATV Accident in Capitol Forest Kills Man; Passenger Injured
A collision with a tree early Saturday killed the driver of an ATV and seriously injured his passenger in Capitol Forest in Thurston County, Washington.

The passenger, Cullen A. Jensen, sustained serious internal injuries and was transported to Providence St. Peter Hospital in Olympia.

Alcohol and speed are believed to be contributing factors.

This unfortunate accident raises several questions from the passenger's perspective. Will there be an applicable auto insurance policy that may provide "no fault" medical payment benefits or liability coverage for the driver? Will Washington's "comparative fault" statute for passengers who know the driver is intoxicated apply here? Given the serious nature of Mr. Jensen's injuries, these are certainly questions worth exploring.
