Kalama Crash Kills One, Injures 5

An SUV being driven by a 15-year old boy crashed in Kalama Tuesday, killing a passenger, critically injuring another and hospitalizing two others.

The passenger who died was named Samantha Garner. Reportedly the accident occurred when the SUV rolled over and struck a tree. Fortunately the driver and two other passengers did not sustain life-threatening injuries.

The driver's parents may well face claims based on the "family car" doctrine or a negligent entrustment theory. The family car doctrine imposes liability where the parents own, provide or maintain the car and it is for the general use, pleasure, and convenience of the family. Negligent entrustment applies where a parent lets his or her child drive even though he or she knows (or should know) the child cannot operate the vehicle safely.
